Terms & Conditions
a) “User” means anyone using the Candrian Creatives Website, who is 18 years of age and over
b) “Candrian Creatives” means any photographer or videographer working for or on behalf of Candrian Creatives.
c) “The Client” means any person, body of persons, firm or company with whom the Photographer enters into a contract for the sale of goods or provision of services by Candrian Creatives.
d) “Session” means the photography, video, reels, self-tape, audition, commercial, corporate, educational, podcast, media, or other creative session agreed to take place on a specified date and time.
e) “Terms and Conditions” means these Terms and Conditions.
f) “Website” refers to www.candriancreatives.com
g) “Footage” and/or “Images” means all photographic material including but not limited to photographs, prints, digital scans, video files, digital files, digital image, artwork, montages and other type of physical or electronic material and/or any other photographic product or other product comprising or containing reproduction of any form of photographic material and which may be offered for the purpose of reproduction and which has been created by Candrian Creatives.
h) “Reproduction” includes any form of publication or copying of the whole or part of any photograph whether altered or not and whether by printing, photography, projection (whether to an audience or not), electronic or mechanical reproduction or storage, electronic transmission or for any use as an artist´s reference or illustration, or in a layout or presentation to include non-commercial image sharing internet resources.
i) These terms & conditions shall apply to the contract to the exclusion of any other terms& conditions put forward by the client.
j) References in the Terms and Conditions to the singular will include the plural and vice versa, and references to gender will include all genders.
1. Definitions
a) Deposit: A deposit of £50.- is required to secure a booking.
b) Full Payment: The remaining balance is due latest 2h before the photoshoot. Payment must be made in full before any images or footage is released. Payments can be made via Stripe.
c) Where payment is made after the two hour period, Candrian Creatives reserves the right to apply an additional fee of ten percent (10%) of the total session price.
d) Discounts of any kind cannot be combined, transferred or paid out.
2. Payment
a) Any deposits paid are nonrefundable. (If Candrian Creatives has to reschedule the clients session, a refund may be granted at their discretion.)
b) The session can be rescheduled up to two times. The session can be rescheduled up to 24 h before their session.
c) If the client has booked an outdoors/weather-dependent photo session, Candrian Creatives will contact and advise the client to reschedule due to unsuitable weather, should your booking date be flexible. The session will be moved to the next suitable/available date at no additional cost.

4. Downgrading Session
a) Clients may request to downgrade their booked session; however, any difference in price between the original session and the downgraded session is non-refundable under all circumstances.
b) All downgrade requests must be submitted in writing (email, text, or DM). Downgrades are only confirmed once Candrian Creatives has acknowledged the request in writing.
5. Session Requirements
a) Clients must submit all required materials, backing tracks, no later than 72h (3 days) before your session. Late submissions will result in an additional fee of £10 per track.
6. Retouching and Re-Edits
a) Retouch notes provided by the Client will be considered but are not guaranteed. Final editing and retouching decisions remain at Candrian Creatives
b) Clients are entitled to one complimentary re-edit (this applies to Images and Video work).
i) Additional Video re-edits result in a fee of £100 per hour, billed in 30min. increments.
ii) Additional Image re-edits result in a fee of £15.
c) No alteration, addition to, deletion from, adaptation, editing, filtering, AI manipulation, or modification of any Image or Video maybe made without Candrian Creatives written permission, except for ordinary cropping or resizing required for permitted self-promotional use.
d) Subjective dissatisfaction, personal preference, or the opinion of the Client does not by itself entitle the Client to request a refund, refuse payment, or dispute payment, provided the services were executed with reasonable care and skill and in line with the agreed service.
7. Retention period
All image, video and audio footage will be stored by Candrian Creatives for three months from your session. After that period, all footage will be deleted and no extra or re-edits can be purchased anymore.
The client(s) herby allow(s) Candrian Creatives to display any photograph covered by this contract and to generally promote the business in advertising, competitions, brochures, magazine articles, blogs, websites, sample albums etc. and the client(s) also give Candrian Creatives permission to tag them on social media.
8. Website Display and Promotional Usage
13. Jurisdiction
a) All the content on the Website, including, but not limited to, text, graphic, logos, icons, images, sound, video clips, data compilations, page layout, underlying code and software is the property of the Company or other relevant third parties. By continuing to use the Website the User acknowledge that such material is protected by applicable English Law and International Intellectual Property law.
b) The User is not entitled to reproduce, copy, distribute, store or in any fashion re-use material from the Website unless given permission to do so by Candrian Creatives.
9. Intellectual Property
The Candrian Creatives website may contain links to third-party websites. Candrian Creatives is not responsible for the content or services provided by such websites and assumes no liability for any issues that may arise from their use.
10. Links to third Party’s Websites
a) Candrian Creatives does not warrant or represent the completeness or accuracy of the information published on their Website and or that the material on their Website is up to date.
b) Candrian Creatives reserves the right to discontinue or alter any or all of their Website at any time in their sole discretion without notice or explanation and save to the extent expressly provided otherwise in these Terms and Conditions, the Client will not be entitled to any compensation or other payment upon the discontinuance or alteration of the Website.
11. Warranties
To the maximum extent permitted by law, Candrian Creatives accepts no liability to the User in respect of:
a) any losses arising out of any event or events beyond their reasonable control;
b) any business losses, including, without limitation loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill;
c) any loss or corruption of any data, database or software;
d) any special, indirect or consequential loss or damages;
12. Limitation of Liability
a) England is the applicable place of jurisdiction.
b) If any provision of these Terms and Conditions is deemed unlawful or unenforceable by any court or competent authority, the remaining provisions will continue in effect.
