Terms & Conditions Photography

“The Photographer” means any photographer or videographer working for or on behalf of Candrian Creatives.

“The Client” means any person, body of persons, firm or company with whom the Photographer enters into a contract for the sale of goods or provision of services by the Photographer.

“Terms and Conditions” means these Terms and Conditions.

“Website” refers to www.candriancreatives.com

“Images” and/or “Photographs” means all photographic material including but not limited to photographs, prints, digital scans, video files, digital files, digital image, artwork, montages and other type of physical or electronic material and/or any other photographic product or other product comprising or containing reproduction of any form of photographic material and which may be offered for the purpose of reproduction and which has been created by the Photographer.

“Reproduction” includes any form of publication or copying of the whole or part of any photograph whether altered or not and whether by printing, photography, projection (whether to an audience or not), electronic or mechanical reproduction or storage, electronic transmission or for any use as an artist´s reference or illustration, or in a layout or presentation to include non-commercial image sharing internet resources.

These terms & conditions shall apply to the contract to the exclusion of any other terms& conditions put forward by the client.

References in the Terms and Conditions to the singular will include the plural and vice versa, and references to gender will include all genders.

1. Definitions

Deposit: A deposit of £50.- is required to secure a booking.

Full Payment: The remaining balance is due within 24h after the photoshoot. Payment must be made in full before any images or footage is released. Payments can be made via Stripe.

Discounts of any kind cannot be combined, transferred or paid out.

2. Payment

Any deposits paid are refundable for cancellations made up to 24h before the photoshoot. If you have to reschedule, please do so at least 24h prior to your booking date.

Should you/your child/ren be ill or have a family emergency, death in the family or any other life-altering situation, you may reschedule your session - please notify us as soon as possible (preferably at least 24h in advance if possible).

If you have booked an outdoors/weather-dependent photo session, we will contact and advise you to reschedule due to unsuitable weather, should your booking date be flexible. Your session will be moved to the next suitable/available date at no additional cost.

3. Cancellation

Ownership: The photographer retains copyright of all images and footage created. Clients must not reproduce or copy images or footage without permission. Use of images or footage for commercial purposes without permission is subject to additional fees and damages. Any negatives and/or digital files shall remain the sole property of Candrian Creatives.

Additional Usage: Any use beyond what was agreed upon during quoting is subject to new permissions and may include extra charges.

License: A non-commercial licence is granted at no cost as long as credit is given. Commercial use requires explicit permission and may involve fees.

The client understands that no unedited images or RAW files will be released at any time.

The raws and .jpegs files will be stored for one year.

4. Copyright and Usage

The client(s) herby allow(s) Candrian Creatives to display any photograph covered by this contract and to generally promote the business in advertising, competitions, brochures, magazine articles, blogs, websites, sample albums etc. and the client(s) also give the photographer permission to tag them on social media.

Terms & Conditions Rerformer Pilates

“Client” means anyone booking and attending a Reformer Pilates session. It also includes, in case of a booking placed for two people , the second person, that will attend the session.

“Terms and Conditions” means these Terms and Conditions.

The Client may not attend any session without first booking and paying for the relevant session.

3. Bookings and Canellations

Any Reformer Pilates Session payments are refundable for cancellations made up to 24h before the Reformer Pilates Session. If you have to reschedule, please do so at least 24h prior to your booking date.

By agreeing to these Terms and Conditions, Clients hereby confirm that they have no health problems (including without limitation cardiac irregularities; spinal, bone, joint, tendon or ligament injuries; spells of dizziness; asthma (or other breathing difficulties); diabetes, epilepsy or any allergy) which may affect their participation in any Reformer Pilates sessions. Clients must notify Candrian Creatives of any pre-existing medical conditions, pregnancy, or injuries.

Accidents or injuries occurring on the premises must be reported to a staff member immediately.

Clients shall not be allowed to attend any session whilst under the influence of alcohol or drugs. In the event they do attend, this is entirely at their own risk.

Candrian Creatives reserves the right to refuse access to any Client if, at our absolute discretion, we consider that the health of the individual concerned may be endangered by the use of our facilities.

4. Fitness, Health and Safety

Candrian Creatives is not specialised for Pre&Postnatal clients, therefore Candrian Creatives does not accept Pre & Postnatal clients and advice them to find a Reformer Pilates Studio that is specialised for Pre & Postnatal clients.

5. Pregnancy (Pre & Postnatal)

By participating in a reformer pilates session or using equipment, clients assume all risks associated with physical activity, including injury from improper use of the equipment.

It is the responsibility of each client to ensure that they are physically capable of participating in the exercises offered during any reformer pilates session. Clients acknowledge the risk of injury associated with physical exercise and the use of specialist equipment. Clients are advised to seek medical advice before starting any fitness program. The advice provided by Candrian Creatives instructors does not substitute for professional medical advice.

Candrian Creatives accepts no liability for any loss or damage to a client’s personal property, or for any injury to clients within the Studio premises or outside the Studio, except where such loss, damage, or injury cannot be excluded by law.

In consideration of their participation in the activities and programs of Candrian Creatives and the use of facilities and equipment owned and/or under the control of Candrian Creaties the client hereby waives and releases Candrian Creatives from any and all responsibility or liability for injuries or damages resulting from their participation in any of Candrian Creatives's activities or use of Candrian Creatives’s equipment or facilities save in respect of death or personal injury caused by the negligent act or omission of Candrian Creatives.

6. Limitation of Liability

Clients are requested to wear a form of dress appropriate to the practice of Pilates. Clients should attend sessions barefoot or, if preferred, with socks. For sessions with focus on pointe work, Clients have to bring their own pointe shoes.

General Terms & Conditions

1. Definition

All the content on the Website, including, but not limited to, text, graphic, logos, icons, images, sound, video clips, data compilations, page layout, underlying code and software is the property of the Company or other relevant third parties. By continuing to use the Website the User acknowledge that such material is protected by applicable English Law and International Intellectual Property law.

The User is not entitled to reproduce, copy, distribute, store or in any fashion re-use material from the Website unless given permission to do so by the Company.

2. Intellectual Property

The Candrian Creatives website may contain links to third-party websites. Candrian Creatives is not responsible for the content or services provided by such websites and assumes no liability for any issues that may arise from their use.

3. Links to third Party’s Websites

Candrian Creatives does not warrant or represent the completeness or accuracy of the information published on their Website and or that the material on their Website is up to date.

Candrian Creatives reserves the right to discontinue or alter any or all of their Website at any time in their sole discretion without notice or explanation and save to the extent expressly provided otherwise in these Terms and Conditions, the Client will not be entitled to any compensation or other payment upon the discontinuance or alteration of the Website.

4. Warranties

To the maximum extent permitted by law, the Company accepts no liability to the User in respect of:

any losses arising out of any event or events beyond their reasonable control;

any business losses, including, without limitation loss of or damage to profits, income, revenue, use, production, anticipated savings, business, contracts, commercial opportunities or goodwill;

any loss or corruption of any data, database or software;

any special, indirect or consequential loss or damages;

If any provision of these Terms and Conditions is deemed unlawful or unenforceable by any court or competent authority, the remaining provisions will continue in effect.
